Wheelchair Accessibility Policy

1. Purpose
MUV Technologies Inc. (“MUV,” “we,” “us”) is committed to ensuring that our rideshare services are accessible and equitable for all riders, including those who use wheelchairs or other mobility devices. This policy is intended to comply with applicable federal laws—including the Americans with Disabilities Act (ADA)—and Texas state laws and regulations governing transportation network companies (TNCs) and accessibility, including those under the Texas Department of Licensing and Regulation (TDLR). 2. Scope
This policy applies to:
Riders who use wheelchairs or mobility devices (manual or powered) whether fixed-frame or foldable;
All MUV driver‑partners who have opted-in for wheelchair transport;
All employees, contractors, and agents responsible for operations or customer support;
All rides requested through the MUV platform operating in Texas.
3. Definitions
Wheelchair‑Accessible Vehicle (WAV): A vehicle that has been modified to accommodate a rider using a wheelchair who cannot transfer easily into a standard seat. This includes appropriate entry (ramps or lifts), interior space, securement devices, and other safety features.
Fixed‑Frame Wheelchair: A wheelchair whose frame does not collapse or fold in such a way as to reduce its footprint significantly.
Foldable Wheelchair / Collapsible Mobility Device:A mobility device which can be folded or collapsed so it can be carried or stored, possibly in the trunk or backseat, without needing a full van conversion for accessibility.
4. Rider Rights
Riders using wheelchairs have the following rights when using MUV services in Texas:
1. Right to Request a WAV: Riders may indicate through the app that they require a wheelchair‑accessible vehicle.
2. No Additional Charge Because of Disability: MUV will not impose extra fees or surcharges for transporting a rider who uses a wheelchair or because of the nature of their mobility device. This includes when a WAV must be used. ([Texas Legislature Online][2])
3. Referrals When WAV Not Available: If a WAV is not available, and a rider makes a proper request, MUV will refer the rider to an alternate provider of wheelchair‑accessible service, if such is available in the local area. ([TDLR][1])
4. Equal Treatment: Riders with wheelchairs shall not be subject to discrimination in terms of rate, wait time, vehicle condition, or service quality because of their use of a wheelchair.
5. Driver / Vehicle Partner Responsibilities
MUV driver‑partners and vehicle partners must comply with the following:
Accept Riders with Wheelchairs: If you are driving a WAV, you must accept ride requests from riders who require wheelchair‑accessible transport.
Ensure Proper Equipment: The vehicle must be equipped with working ramps or lifts
(if applicable), securement devices to safely secure wheelchairs, and sufficient interior space so that the rider can ride safely in their mobility device.
Safety First: Ensure that the wheelchair and its occupant are secured properly, as per safety standards, before beginning the trip.
No Refusal Based on Wheelchair (Unless Legally Justified): Drivers may not refuse to pick up a rider purely because they use a wheelchair, except where doing so would create a safety risk or is physically impossible (for example, vehicle cannot safely accommodate the device).
Training: Drivers must undertake any training MUV provides (or requires) regarding wheelchair securement, safe operation of ramps/lifts, and assistance of riders with wheelchairs.
6. App / Booking Features
To support accessibility:
The MUV app will provide an option to indicate that the rider requires a Wheelchair‑Accessible Vehicle when booking.
The app should clearly explain what kinds of wheelchair / mobility devices can be accommodated.
In areas where WAVs are scarce, the app may display when a WAV is not available, and offer referral information or alternative providers.
7. Compliance with Texas Law & Regulations
MUV must comply with applicable Texas laws including, but not limited to:
Texas Transportation Code / Texas Occupations Code provisions for TNCs regarding accessibility, including pilot programs for WAV services. ([TDLR][1])
House Bill 100 (85th Texas Legislature), which requires TNCs to allow riders to indicate the need for a wheelchair‑accessible vehicle, prohibit extra charges due to disability, and make referrals when WAVs cannot be provided. ([Texas Legislature Online][2])
Texas Human Resources Code, as applicable for nondiscrimination in public accommodations.
8. Reporting and Resolution
If a rider believes their rights under this policy have been violated:
They may report the incident via the MUV in‑app support, email info@gottamuv.com, MUV will investigate all reports promptly, fairly, and confidentially.
Possible remedies include: driver retraining, warnings or suspension for driver‑partners, refunds to riders if service fell short, or other corrective actions.
9. Enforcement and Consequences
Violations of this policy by driver‑partners or by MUV operations may result in:
Written warnings;
Mandatory additional training or retraining;
Temporary suspension of service;
Permanent deactivation from the platform;
Any fines or penalties as may be imposed under applicable state regulations.
10. Review and Updates
MUV will review this policy at least annually, or sooner if there are changes in:
Texas or federal accessibility laws;
Best practices in wheelchair accessible transport;
Feedback or complaints from users with mobility devices.
